The demolition industry faces numerous rules and regulations from the Department of Labor (DOL) and National Labor Relations Board (NLRB) that directly impact demolition contractors and their workers. NDA actively monitors regulations from the Department of Labor and ensures members are up to date on the latest guidance. Below, members will find the latest guidance documents from key DOL agencies. 


Occupational Safety and Health Administration

With the Occupational Safety and Health Act of 1970, Congress created the Occupational Safety and Health Administration (OSHA) to ensure safe and healthful working conditions for workers by setting and enforcing standards and by providing training, outreach, education and assistance.

State Plans are OSHA-approved workplace safety and health programs operated by individual states or U.S. territories. There are currently 22 State Plans covering both private sector and state and local government workers, and seven State Plans covering only state and local government workers. State Plans are monitored by OSHA and must be at least as effective as OSHA in protecting workers and in preventing work-related injuries, illnesses and deaths. Wage and Hour Division

The Wage and Hour Division (WHD) enforces federal minimum wage, overtime pay, recordkeeping, and child labor requirements of the Fair Labor Standards Act. WHD also enforces the Migrant and Seasonal Agricultural Worker Protection Act, the Employee Polygraph Protection Act, the Family and Medical Leave Act, wage garnishment provisions of the Consumer Credit Protection Act, and a number of employment standards and worker protections as provided in several immigration related statutes. The WHD also enforces requirements from the Davis-Bacon and Related Acts for the construction industry.
