PCB's in Caulk

PCB's in Caulking has come to the national forefront for owners, managers, contractors and consultants.  For years, this environmental dimension was rarely discussed and/or addressed as an environmental concern for parties that have some level of liability to identify, maintain, demolish, remediate and/ or dispose of regulated caulking products.  Although banned from manufacturing in 1979, many products that were still in inventory continued to be used in caulking materials.  As these structures are renovated or demolished, the potential to encounter PCB regulated materials, as defined by 40 CFR Part 761, is likely.

In an effort to identify the regulatory requirements, assessment, monitoring and accountability methodologies, along with the liabilities for all of the parties that may be involved in a project, the NDA has convened a panel of experts that will: provide an overview of the PCB in Caulking Rule, discuss assessment procedures and work plan development, and identify some of the legal responsibilities and exposures that exist for all parties involved in projects where PCB's are encountered.
Our panel of experts include:
Ms. Kim Tisa, USEPA Region I PCB Coordinator.  Ms Tisa is responsible for the approval of PCB remediation Plans for the five northeastern states, Connecticut, Massachusetts, Maine, New Hampshire, Rhode Island and  Vermont.  In her capacity as the Regional PCB Coordinator in Boston, Massachusetts, Kim has overseen numerous Remediation Plan reviews and approvals and is considered by her peers to be the most prolific and experienced regional coordinator in the nation.
Mr. John Woodyard, P.E., Vice President with Weston Solutions, has over 30 years of environmental consulting experience with a heavy concentration of his work being in the areas of PCB assessment, regulatory negotiation, remedial action plan development and oversight.  John will provide the group an overview of the assessment, remediation plan and oversight requisites that have typically been experienced and provide participants with a better understanding of the requisites to project execution.
Mr. Christopher Bell, Esq., a shareholder with Greenberg Traurig of Houston, Texas, has close to 30 years of experience in practicing law, with significant concentration of his expertise being in the environmental compliance area of TSCA and was involved in some of the earliest PCB in Caulking negotiations between responsible parties and the USEPA in the country.  Chris will contribute with his experience in dealing with regulatory agencies and provide information of the responsibilities and liabilities for owners and contractors.
Jim Graham, Chair of the NDA's Environmental Committee and Executive Vice President/ Principal with Winter Environmental/ Winter Construction, will serve as the moderator for the panel.
